This Privacy Policy describes how myAyu  ("myAyu") protects your Personal Information and Personal Health Information when you use this web site, www.myayu.com, myAyu, and all related products and services (collectively, the "Service"). myAyu can be contacted by email at hello@myayu.com. All references to myAyu include its subsidiaries or affiliates involved in providing the Service. All references to you indicate you as the sole Authorized Individual.

Your use of the Service is subject to this Privacy Policy as well as our Terms. After reading this Privacy Policy, you will know:

Definitions

Aggregate Data

Aggregate Data is PHJ Data that is: (1) grouped so it does not connect to you as an individual and (2) has names and other identifiers removed or altered. In other words, Aggregate Data is de-identified data and cannot be used to identify you as an individual.

Authorized Individual

An Authorized Individual is you, the user of the Service.

 

De-identified Data

De-identified Data is PHJ Data that has names and other identifiers removed or altered. In other words, De-identified Data is stripped of personally identifying information and cannot be used to identify you as an individual.

 

PHJ

"PHJ" means Personal Health Journal. A PHJ is a collective set of electronic, Personal Health Information volunteered by you to myAyu. You can collect, manage and share your PHJ in myAyu.

 

PHJ Data

When you sign up for myAyu, you provide your own Personal Information and you volunteer your own Personal Health Information. This information makes up PHJ Data.  Any information of your PHJ in myAyu is considered PHJ Data. PHJ Data might include, but is not limited to the following:

  • Your name and contact information, such as your address, phone number, or email address

  • Demographic information, such as your age, gender, ethnicity, and occupation

  • Your personal health history, current health activities, diet, exercise, routines, sleep, emotions, wellbeing and related information

  • Your medical history, conditions, treatments, and medications

  • Computer information, such as your IP address and "cookie" preferences

 

As described further below, myAyu may use your PHJ Data to achieve the following:

  • Operate and manage the myAyu platform, software, and website

  • Maintain and protect its computer systems

  • Comply with the law, such as responding to subpoenas and search warrants

 

PHJ Data includes Personal Information and Aggregate Data.

 

Personal Health Information

Personal Health Information means information about your personal health that could reasonably be considered to be of personal nature. Personal Health Information is information that you volunteer, or provide voluntarily, which may include, but is not limited to the following:

  • Your demographic information

  • Your health goals, and obstacles

  • Your health activities, diet, digestion, exercise, routines, sleep, emotions, wellbeing and related information

  • Your personal health history

  • Your medical history, conditions, treatments, and medications

 

Personal Information

Personal Information means information about you that reasonably can be linked to you such as, but not limited to:

  • Your first and last name

  • Your contact information

  • Your financial information

 

Reporting

myAyu and our Service Providers might report about business activities and customers (you) to others, such as investors, auditors, potential business partners, or public communities. Reports will not include Personal Information without your specific permission or as permitted or required by law.

 

Service Providers

A Service Provider is an entity that is hired to perform certain functions for myAyu to support the development, maintenance, and implementation of myAyu. Service Providers may include Ayurvedic Educational Consultants, software or website designers and data storage providers.

 

Security Measures

Security measures can include computer safeguards, secured files, and staff security training. In addition, myAyu may be required by law to notify you about particular data breaches.

 
What Information myAyu Collects
  1. Before you register for the Service: When you engage with the site or call us, we may ask you to provide us with Personal Information, or you may otherwise provide us with Personal Information that could reasonably be used to identify you personally. Additionally, we may ask you to provide us with Personal Health Information. We may collect this information through various forms throughout the site, including, but not limited to: email, chat, request forms, data collection forms, “contact us” forms, or surveys. Depending on the activity, some of the information we ask you to provide may be mandatory. If you do not provide the mandatory information with respect to the particular activity, you will not be able to engage in that activity.
     

  2. To use the Service: You must become a Member of myAyu and complete the registration process, which includes accepting the Privacy Policy, Terms and Health Education Membership Agreement. As part of the registration process, you may be asked to provide certain information, such as, but not limited to, your name, email address, zip code, phone number, demographic information, health goals, obstacles and related information. Some of this, such as your name and contact information, is required to complete the registration process. While using the Service, you may volunteer your information which will be saved to your Personal Health Journal in myAyu. By providing your information, myAyu is able to provide you with specific Ayurvedic education that is relevant to you and your health. By saving your information in your Personal Health Journal, you don’t have to enter it each time you use myAyu and this will enhance your use of the Service.
     

  3. In general, myAyu collects all the information that you directly supply, provide, volunteer or otherwise share to the Service. myAyu also may collect information from certain Service Providers whom you expressly authorize to use the Service with respect to you and your information (each, a "Provider" and collectively, the "Providers"). By authorizing a Provider, you also authorize myAyu to collect information regarding you from your Provider's support staff and from other practitioners affiliated with your Provider or in your Provider's practice.
     

  4. myAyu passively collects information from you as you navigate through our Service. myAyu may track IP addresses, use industry standard tracking devices (e.g., session and persistent cookies, flash cookies, web beacons), and electronically gather information about the technology you use to access the Service and the areas of the Service you utilize. myAyu passively collects this information for operational purposes such as evaluating, updating and improving the Service.
     

Cookies help us in many ways to make your visit to our websites more enjoyable and meaningful to you. Cookies are text information files that your web browser places on your computer when you visit a website. myAyu may use such "cookie" technology to obtain non-personal information from you as an online visitor. As an example, this might entail recognizing several web page requests coming from the same computer and therefore the same visitor. Most browsers accept cookies automatically, but can be configured not to accept them or to indicate when a cookie is being sent. If you do not wish myAyu to collect cookies, you may set your browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of the Service may then be inaccessible and you may not receive the full benefits of the Service.

How myAyu Uses Your Information
  1. myAyu uses your information to provide the Service as described on the web site and Terms, as well as to enhance the performance of the Service and/or create new services. myAyu will not use Personal Information for product development or product enhancement without your express, written permission.
     

  2. If you purchase a Service that involves or requires a Service Provider, then you expressly provide permission for myAyu to share your Personal Health Journal with the Service Provider to facilitate the exchange of information and communication between you and your Provider (see “Sharing your Information with Third Parties”).
     

  3. Communications between you and your Provider may be initiated by you or your Provider. You are under no obligation to initiate or respond to such communications. By participating in such communications, you agree that some or all of your PHJ Data contained in myAyu may be shared with your Provider. myAyu will not alter the content of the communications. However, myAyu may remove or block any content that myAyu deems offensive, indecent, or otherwise objectionable or in violation of applicable law. myAyu may keep a record of all communications between you and your Providers. myAyu will not share the content of such communications except as permitted under this Privacy Policy, the Terms, or as required by law, unless you expressly consent to or authorize disclosure.
     

  4. myAyu will not sell or rent your Personal Information without your written consent. myAyu will not use or disclose your Personal Information, except as described in this Privacy Policy, the Terms, or as permitted or required by law.
     

  5. If you elect to utilize any billing services features of the Service, myAyu also may use your information to process payments, send invoices and conduct other billing-related activities as requested by you.
     

  6. myAyu may use your information to send you promotional content about the Service by email, phone and similar forms of communication from us or our partners (acting on our behalf). If you do not wish to receive such promotional messages, you may change your settings in your Account or notify us at any time at hello@myayu.com.
     

  7. myAyu may also contact you with important information regarding the Service, such as in the event a certain service is temporarily suspended for maintenance, to reply to your support inquiries, or send you notices regarding payments for your membership or services.  It is important that you are always able to receive such messages. For this reason, you are not able to opt-out of receiving such service and billing messages unless you are no longer a user of the Service. These types of messages are not encrypted. However, if we need to share information with you of a sensitive nature, we will direct you to log into myAyu in order to receive such information securely.
     

  8. myAyu may also use your personal information for other legitimate interests, such as, but not limited to, enhancing our data security and fraud prevention capabilities and tools, supporting legitimate interests that we have as a business (such as for by identifying user trends) and complying with any applicable laws and regulations or in connection with legal proceedings.

 
Sharing Your Information with Third Parties
  1. myAyu may make your Personal Information available to third parties participating in the Service that are authorized by you or as necessary to complete transactions you authorize.
     

  2. myAyu may disclose your Personal Information to myAyus' Service Providers that provide educational services, customer support, technical support or other services to myAyu related to the Service. All such Service Providers are subject to confidentiality obligations and may only access and utilize your data for purposes of fulfilling their obligations to myAyu.
     

  3. myAyu does NOT provide or sell Aggregate Data that is de-identified to third parties.
     

  4. If a third party acquires the assets of myAyu related to the Service and its products and services (whether by sale, merger, change of control, bankruptcy or otherwise), myAyu reserves the right to transfer your Personal Information to the new owner(s). In such case, your Personal Information would remain subject to the provisions of the myAyu Privacy Policy that was in effect immediately prior to the transfer unless myAyu provides you notice otherwise.

 
Choices You Have About How myAyu Uses Your Information
  1. Managing Your Account. You have the following choices regarding the Personal Information you provide to myAyu for use:

    1. Generally, you may change how your information is used and disclosed through the account settings and account management features.

    2. You may access your myAyu account at any time to review your PHJ Data. To request a change to any of your Personal Information, log into your myAyu account and use the related functions to access, update and save your changes. Not all of your information can be updated depending on the functionality of the Service. 
       

  2. Deactivating a Service Provider. You may revoke any Service Provider’s authorization to communicate with you, access your Personal Health Journal, or request information from you through the Service by utilizing the account management tool of the Service. Once revoked, the Service Provider may no longer access and use the Service with respect to you and your Personal Information. Any disclosure of your PHJ Data or Personal Information made prior to the authorization is subject to the confidentiality obligations of the Service Provider with myAyu.
     

  3. Terminating Your Account. You may terminate your myAyu account at any time by notifying us at hello@myayu.com.  myAyu will maintain and/or destroy all PHJ Data and Personal Information associated with your account in accordance with its then current document retention and destruction policies.

 
Data from Children Under the Age of 18

The Service is designed for adults 18 years of age or older. The Service is not intended for use by children younger than 18 years old. myAyu will not knowingly collect information or solicit any information from site visitors younger than 18 years.  If we learn or are informed that we unintentionally collected personal information from an individual under the age of 18, we will delete such information. If you believe that we might have any information regarding a person under the age of 18, please contact us at privacy@myayu.com.

 
How myAyu Protects Your Information

myAyu uses both technical and procedural Security Measures to maintain the integrity and security of the Personal Health Journal and other databases. The safety and security of your Personal Information also depends on you. Never share your password with anyone else. Notify myAyu promptly if you believe your password has been breached. Also, remember to log off of the myAyu site before you leave your computer.

 
Transfer of Information to the United States

Our site is operated in the United States and intended for users located in the United States. If you are located outside of the United States, please be aware that information we collect, including Personal Information, may be transferred to, processed, stored and used in the United States. The data protection laws in the United States may differ from those of the country in which you are located, and your Personal Information may be shared with third parties for direct marketing purposes and may be subject to access requests from governments, courts, or law enforcement in the United States according to the laws of the United States. By using our site or providing us with any information, you consent to the transfer to, and processing, usage, sharing and storage of your information, including Personal Information, in the United States as set forth in this Privacy Policy.

 
Security Breach Notification Requirements

Pursuant to applicable law, myAyu may be required to send you notice of security breaches or suspected security breaches that impact your Personal Information. In the unlikely event that myAyu must provide you a notice of a security breach, myAyu will send you security breach notices to the e-mail address contained in your account information unless we are otherwise required by law. Please note: many e-mail systems have built in SPAM filters. If you have one in place, you should check with your system administrator or the available instructions to confirm that emails from myAyu are not blocked by the filter (e.g., by confirming that the Service domain name (myayu.com) is a permitted domain name.

 
Changes to this Privacy Policy

myAyu reserves the right to change the Privacy Policy in its sole discretion. In such case, myAyu will post the new Privacy Policy on the web site and the effective date of the new Privacy Policy will be clearly marked. If myAyu updates this Privacy Policy, your continued use of the Service (following the posting of the revised Privacy Policy) means that you accept and agree to the terms of the revised Privacy Policy. Remember, by using any part of the Service, you accept and agree to our Privacy Policy and privacy practices.

 
Governing Law

This Privacy Policy, its interpretation, and any claims and disputes related to it, shall be governed by, interpreted and enforced in accordance with the laws of the State of Texas. Any claim and dispute shall be brought in and decided by a court of competent jurisdiction located in Collin County, Texas.

 
Severability

To the extent any provision of this Privacy Policy is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
